Today, the Centers for Medicare & Medicaid
Services (CMS) issued an Informational Bulletin (CIB) that describes our intent
to use enforcement discretion to focus on working with states to achieve
compliance with the managed care regulations when states are unable to
implement the July 1, 2017 requirements of the final rule. To implement
this enforcement discretion, states will need to identify for CMS those
regulations of the final rule that they are unable to implement by the required
compliance date. This flexibility will not apply to the actuarial soundness,
medical loss ratio (MLR), and pass-through payment provisions of the final rule
because of the significant federal fiscal implications of these provisions for
the Medicaid program.
