Massachusetts education leaders are facing at least six lawsuits against
their universal mask mandate for public school students and staff
members, a requirement extended this week until at least Nov. 1, apart
from schools that can prove they've reached an 80 percent vaccination
threshold.
Robert Fojo, a New Hampshire-based attorney who has filed five of the
lawsuits, told me today that his complaints allege that neither the state
Department of Elementary and Secondary Education nor individual schools
districts have the authority to mandate mask-wearing.
“Wearing a mask should be a personal choice between a parent and a
child,” he said. “It should not be imposed on them by a school district
that lacks the expertise or authority concerning these broad health
measures.”
